Terms of service

This is the agreement between you and Skyro Cloud. It covers what you are renting, what you pay, what you must not do with a cloud phone, and how either of us can bring it to an end.

The agreement

These terms are between you and FILL IN: registered company name ("Skyro Cloud", "we", "us"), the operator of www.skyrocloud.com and the Skyro Cloud Android app.

By creating an account or using the service you accept these terms. If you do not accept them, do not use the service. Our privacy policy is part of this agreement.

You must be at least 16, or older if your country requires it, and able to enter a contract. If you are using Skyro Cloud for an organisation, you confirm you may bind that organisation.

What the service is

Skyro Cloud rents you an Android device that runs on our servers and that you reach by streaming it to the app. You choose a plan, which fixes the processor, memory and storage the phone gets, and a term, which fixes how long you have it for.

What you are buying is use of a phone for a period. You are not buying the hardware, and you do not get an ownership interest in anything of ours.

A real Android device

It runs on our servers and streams to your app. Install what you like; it behaves like a phone because it is one.

For the time you buy

From a day to a year. It keeps running until the term ends, and you decide whether it renews.

Not a certified handset

Some apps refuse to run on it, banking and streaming apps most often. We cannot make them accept it.

Not a backup service

Keep your own copies of anything you cannot lose. A lapsed phone's storage is erased on the schedule below.

Some things a cloud phone is not:

  • It is not a certified retail handset. It reports itself as an emulator-class device and is not Play Protect certified, so some apps may warn about it, behave differently, or refuse to run. Banking, payment, streaming and anti-fraud apps are the usual ones. We cannot make an app accept it.
  • It has no SIM, no phone number, no calls or SMS, and no real GPS, camera or fingerprint sensor.
  • It is not a backup service. Keep your own copies of anything you cannot lose.

Your account

  • Give us an email address you actually control. It is where account and security messages go, and how you recover access.
  • Keep your sign-in details to yourself. You are responsible for what happens under your account.
  • Tell us promptly if you think someone else is in it.
  • One person, one account, unless we agree otherwise in writing.

We may keep you from creating an account, or close one, if you have previously broken these terms.

What you may not do

A cloud phone is a real computer with a real internet connection, and it acts under our network's name. These rules are not decoration; breaking them is the fastest way to lose the service without a refund.

You must not use Skyro Cloud to:

  • Break the law of any country that applies to you or to us.
  • Attack anyone: denial of service, port scanning, intrusion attempts, vulnerability scanning of systems you do not own, brute-forcing credentials, or anything similar aimed at other people's systems.
  • Send spam or bulk unsolicited messages of any kind, through any channel.
  • Commit fraud, including creating fake accounts on other services, defeating another service's fraud or bot controls, ticket or sneaker scalping, click fraud, or manufacturing fake engagement, reviews or installs.
  • Distribute malware, run a botnet or command-and-control, or host phishing content.
  • Handle material that sexually exploits children. We report this to the authorities and terminate immediately, with no notice and no refund.
  • Publish or store content that is unlawful where you or we are, that infringes someone's rights, or that harasses or threatens people.
  • Infringe copyright, trademarks or other intellectual property, including pirating apps or media.
  • Mine cryptocurrency, or run anything else whose purpose is to consume as much processing power as it can get.
  • Resell, sublicense or rent out access to your cloud phones as a service to others, without our written agreement.
  • Interfere with the service itself: probing or attacking our infrastructure, escaping the phone's isolation, reaching other customers' phones, evading resource limits, or automating abuse of our API.

You are responsible for everything your cloud phone does, including anything an app you installed does by itself. If you route the phone through a proxy, you are responsible for having the right to use it.

We do not monitor what you do on your phone. We act on what is reported to us, on abuse complaints from other networks, and on what our own systems flag, such as a machine suddenly behaving like an attacker.

Your content

What you put on your cloud phone is yours. We claim no ownership of it and no licence to use it, beyond what is technically required to run the phone for you, storing it, and streaming it to you when you connect.

You are responsible for having the right to hold and use whatever you put there.

Keep your own copies. Storage on a cloud phone is not backed up for you. Deleting a phone, deleting your account, or letting a subscription lapse past its retention window destroys what was on it, permanently. See renewal and expiry.

Paying

  • Prices are shown in the app before you buy, in the currency displayed there, and include any tax we are required to add.
  • You pay for the term you chose, up front.
  • You may pay by card, from your Skyro Cloud wallet balance, or through Google Play where offered. Available methods change; the app shows which ones are open right now.
  • Wallet balance is credit for use on this service. It is not money on deposit, it earns nothing, and it is not transferable to another account.
  • If a payment fails, we retry it a few times over the following days and tell you each time. If it keeps failing, the phone is suspended and then expires.
  • You are responsible for any tax you owe on your own use of the service.

Renewal and expiry

If auto-renew is on, we renew the subscription at the end of each term and charge the payment method or funding you chose. You can turn auto-renew off at any time from the phone's subscription screen, and it stays available until the end of the term you already paid for.

When a subscription ends without renewing:

  • The phone is suspended. It stops running and you cannot stream it.
  • Its storage is kept for a period that depends on how much you had bought for that phone in total. Renew within that window and the phone comes back as it was.
  • After the window the storage is erased permanently. Nothing can bring it back, including us.

"In total" means everything you ever bought for that phone, not the last payment. Twelve monthly renewals count as a year, so they earn the same week as paying for a year up front.

A one-day rental keeps nothing: when the day is up the phone and its storage go. If you may want the phone back, buy a longer term or renew before it lapses.

We notify you before a renewal, when a payment fails, and before storage is erased. Those notices go to your account email address, which is why it must be one you actually read.

Refunds

  • If we fail to deliver what you paid for, a phone that could not be provisioned, or a substantial outage, contact us and we will put it right, with a refund or credit as appropriate.
  • Time you have paid for but not yet used can be refunded to your wallet from the phone’s subscription page in the app: purchases not yet started in full, the period in progress pro rata if you end the phone. Time already served is not refundable. The refund policy has the detail.
  • Deleting your account or a phone before the term ends, without asking for the refund first, forfeits the remaining time, and any wallet balance is forfeited with the account. Refund it or spend it first; an unspent top-up can go back to your card on request.
  • We do not refund where we terminated your account for breaking the acceptable use rules.
  • Purchases made through Google Play are also subject to Google's refund policies.
  • If you are a consumer in a jurisdiction with statutory cancellation or refund rights, those rights stand regardless of anything in this section.

Sharing and transfers

You can share a phone with another person by email invitation, and you can transfer a phone to another Skyro Cloud account.

  • Only invite people who expect to hear from you. Using invitations to send unwanted mail is spam under section 4.
  • Anyone you share a phone with can use it and reach what is on it. Share accordingly.
  • You remain responsible for a phone you own, including what a person you shared it with does on it.
  • A completed transfer is final. The phone, and everything on it, becomes the other account's.

Availability

We work to keep the service up and running, but we do not promise uninterrupted availability and this agreement carries no uptime guarantee. Maintenance, failures, capacity limits and problems at our suppliers all happen.

We may change, add or withdraw features. If we withdraw something you depend on, or make a change that materially reduces what you are paying for, we will tell you beforehand and, if you are mid-term and unhappy, refund the unused portion.

Streaming quality depends on your own connection and distance from the region you chose. We cannot control either.

Suspension and termination

You may stop at any time: turn off auto-renew, delete a phone, or delete your account.

We may suspend or terminate your account or a phone if:

  • you break these terms, in particular section 4;
  • payment fails and stays unpaid;
  • we are required to by law, or by a demand we must honour;
  • your use is endangering our infrastructure or other customers.

We give notice and a chance to fix things where it is reasonable to do so. For serious abuse, attacks on others, child sexual abuse material, fraud at scale, we act immediately and without notice, because waiting would harm other people.

On termination your phones are destroyed and their storage erased. If we terminated you for breaking these terms, no refund is due.

Intellectual property

The service, the app, the site and everything in them other than your own content belongs to us or our licensors. You get a limited, personal, non-transferable right to use them while this agreement is in force, and nothing more.

Android is a trademark of Google LLC. The Android system on your cloud phone is built from the Android Open Source Project and other third-party components, each under its own licence. Skyro Cloud is not affiliated with, endorsed by or sponsored by Google.

If you send us feedback or ideas, we may use them freely and owe you nothing for them.

Disclaimers

The service is provided as is and as available. To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that the service will be uninterrupted, error-free or secure, that a cloud phone will run any particular app, or that data on a phone will never be lost. A phone's storage is encrypted at rest, but as the privacy policy explains, that protects storage which leaves the machine and not against anyone with administrative access to the running server. Judge what you put on a cloud phone accordingly.

Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, your statutory rights are unaffected.

Liability

To the fullest extent the law allows:

  • Neither side is liable for indirect or consequential loss, loss of profit, loss of business, or loss of goodwill.
  • We are not liable for loss of data on a cloud phone. Keeping your own copies is your responsibility under section 5.
  • Our total liability arising out of this agreement, for all claims taken together, is limited to what you paid us in the twelve months before the event giving rise to the claim.

Some jurisdictions do not allow these limits. Where that is so, they apply only as far as the law permits.

Changes to these terms

We may update these terms. The date at the top changes when we do. If a change materially affects your rights, we will tell you in the app or by email at least 30 days before it takes effect, and you may end the agreement before then if you do not accept it. Continuing to use the service after a change takes effect means you accept it.

Governing law

This agreement is governed by the law of FILL IN: governing law jurisdiction, and the courts of FILL IN: courts have jurisdiction over disputes arising from it.

If you are a consumer, this does not deprive you of the protection of the mandatory law of the country you live in, and you may bring proceedings in your local courts.

If any part of these terms is found unenforceable, the rest stays in force.
